Cuban and Mexican fast food restaurant El Rey has been accused in a lawsuit of failing to pay overtime to a member of the kitchen staff, with the possibility of more employees opting in as plaintiffs in the future.

The former employee alleges that El Rey "did not make a good faith effort to comply with minimum wage or overtime provisions contained within the FLSA [Fair Labor Standards Act]" and as such "willfully or with reckless disregard carried out their illegal pattern or practice regarding overtime compensation."

Manuel Diaz, the registered agent for El Rey, could not be reached for comment.
