In the Conroe area sits a little restaurant called El Rodeo which has flown under the radar until now.
In March the actual Rodeo Austin (an actual full-fledged rodeo) brought a lawsuit to the U.S. District Court for the Southern District of Texas to rectify this case of name games. In the decision, they found that Rodeo Austin was too similar to El Rodeo Inc, and ruled in the Austin Rodeo's favor.
In its rejection, the Texas Secretary of State wrote that "the only significant difference between your proposed name and the entity name on file is the geographic designation at the end of the name," and ruled the two names to be deceptively similar. Thus, Rodeo Austin would be required to get permission from El Rodeo to use its desired corporate name.
What do you think? Drop a note in the tip line if you side either way in the case of the rodeo name blame game.
